Mortgage Cancellation After Closing: First Check Whether Rescission Applies
Start with three fictional transaction files, then work through a Thanksgiving calendar and organize questions about your own closing documents.
A calendar is a tempting place to start after a stressful closing. Start with the transaction file instead. Mortgage cancellation has no universal three-day right. Scope: closed-end consumer loans; HELOCs and other open-end credit are excluded.
Use the three fictional files below to prepare a better question for a qualified adviser. They are deliberately narrow examples, not a test that decides your rights.
First, put the transaction in the right file
File A: Buying the home
Maya is buying her first home. Only the newly acquired principal home secures its purchase financing; there is no bridge loan or other home pledged. Exempt under this rescission rule.
File question: Do the signed papers describe only this purchase arrangement, or is there another property or transaction to discuss?
File B: Replacing the loan with a different creditor
A consumer-purpose refinance with a genuinely different creditor, secured by the owner’s existing principal home, qualifies here only with no applicable exemption.
The creditor is not the old creditor’s successor. Keep the new agreement with the old obligation for comparison.
File C: Refinancing with the original creditor
Original-creditor refinancing of already-secured debt is exempt except to the extent of qualifying new advances. Merger, consolidation or acquisition successors can count as original creditors.
An increased balance or cash received alone is not the test; refinancing costs alone are not new advances. Ask for an explanation of the classification using the old obligation, new agreement and itemized costs. Do not settle the question by subtracting two balances on a phone calculator.
Read the CFPB’s rescission rule and official commentary for the governing coverage and exemption provisions. These files are selected examples, not an exhaustive list.
Then choose the starting event
The ordinary deadline is midnight after three business days from the latest of consummation, receipt of the required notice, and receipt of all material disclosures. See § 1026.23(a)(3).
Consummation means becoming contractually obligated on the credit; applicable state law determines when that happens. Do not substitute a date simply because a folder calls it “closing day.” See the CFPB definitions and commentary.
A delayed notice over Thanksgiving: instructional example
Assumptions: Assume File B applies: one entitled consumer; correct, complete material disclosures; valid in-person notice delivery; state-law consummation; no waiver, disputed facts or other exception. These are fictional facts, not findings about your loan. Neither delivery below uses presumed receipt dates.
- Tuesday, November 24, 2026: consummation and personal delivery of all material disclosures.
- Wednesday, November 25, 2026: personal delivery of the required rescission notice.
November 25 is therefore the latest event.
For mortgage rescission, count calendar days except Sundays and the legal public holidays in 5 U.S.C. 6103(a). Saturdays ordinarily count. Observed employee closures do not replace statutory holiday dates. Business-day definition. Thanksgiving is the fourth Thursday of November. Current statutory holiday list.
| Date in 2026 | Entry in the example |
|---|---|
| Thursday, November 26 | Excluded: Thanksgiving |
| Friday, November 27 | Day 1 |
| Saturday, November 28 | Day 2 |
| Sunday, November 29 | Excluded: Sunday |
| Monday, November 30 | Day 3 |
Only under these assumptions: midnight ending Monday, November 30, 2026.
Keep a small evidence log beside the originals
Make a working copy for annotations and preserve the original documents and delivery records. Use one entry for each version and each recipient. If a date is unknown, write “unknown” rather than guessing. This is an organizing aid, not a legal form or cancellation notice.
| Field | What to record |
|---|---|
| Document name and version | Exact heading, file name and any revision label. |
| Recipient | Who received that particular copy. |
| Date | The date claimed and any uncertainty about it. |
| Delivery evidence | Where you saved the envelope, receipt, message or other record. |
| Discrepancy | What differs between versions or between the document and your recollection. |
| Person asked | Name, role, contact date and the question still unanswered. |
For uncertain coverage, missing or inconsistent notices, or disputed dates, seek qualified legal help promptly. Do not wait for an informal reply past a possible deadline. Ask the adviser to address eligibility, timing and how to act on the particular papers you received. This article does not supply a notice to send or instructions for exercising a right.
Keep other loan questions separate
Private-education cancellation follows final-disclosure receipt under a separate rule. Its cancellation clock uses days when the creditor is open for substantially all business functions; its disclosure-receipt count uses the precise calendar definition. See § 1026.48(d) and the business-day definitions. Do not reuse this mortgage calendar for that task.
- Before consummation, use our corrected Closing Disclosure guide to organize a different timing question.
- When comparing loan strategies, see mortgage recast versus refinance.
